1) Social casino disclosures (New Zealand)
- This is a social casino for entertainment only. It is not real-money gambling.
- No prizes of real-world value are offered. Virtual items/currency are non-redeemable and have no cash value.
- Access is intended only for users of legal gambling age in New Zealand: 18+.
2) Acceptance & eligibility
By using therark.com (the “Service”), you agree to these Terms. If you do not agree, do not use the Service. You must be 18+ and able to form a binding contract.
3) Accounts
You are responsible for your account credentials and activity. Provide accurate information and keep it up to date. We may refuse, suspend, or close accounts to protect the Service or comply with law.
4) Virtual currency & items
Virtual currency/items are licensed to you, not sold. They cannot be withdrawn, exchanged for cash, transferred outside the Service, or redeemed for real-world value. We may adjust, remove, or limit virtual items/currency (including balances) where reasonably necessary for integrity, security, maintenance, or compliance.
5) Acceptable use
- Do not cheat, automate, exploit bugs, or interfere with security or performance.
- Do not harass others, post unlawful content, or violate third-party rights.
- Do not attempt to buy/sell accounts or virtual items outside the Service.
6) Intellectual property
The Service, software, and content are owned by The Rark Limited or licensors and protected by IP laws. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal entertainment in accordance with these Terms.
7) Service changes & availability
We may modify, suspend, or discontinue any part of the Service. Planned or unplanned outages may occur. We do not guarantee uninterrupted availability.
8) Disclaimer
To the extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. Nothing in these Terms limits rights you may have under the Consumer Guarantees Act 1993 where it applies and cannot be excluded.
9) Limitation of liability
To the maximum extent permitted by law, The Rark Limited is not liable for indirect, consequential, special, or punitive losses, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the amount (if any) you paid to us for the Service in the 12 months before the event giving rise to the claim.
10) Termination
You may stop using the Service at any time. We may suspend or terminate access (and associated licences) if you breach these Terms or where reasonably necessary for security, integrity, or legal compliance.
11) Disputes & governing law
Please contact us first so we can try to resolve issues informally. These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction.
